Star Nursery Inc. U.S. Privacy Policy and Statement

This Privacy Statement applies to your interactions on the application and consumer site with Star Nursery Inc. as a prospective, current or former Star Nursery customer or visitor. It describes how Star Nursery Inc. collects, uses, and protects personal information from and about you, along with choices you can make about such information. This Privacy Statement also serves as our notice at collection under the California Consumer Privacy Act, as amended (the “CCPA”), and describes the categories of personal information we collect, the purposes for which we use them, whether we sell or share them, how long we retain them, and the rights available to you.
What Information Will We Collect:
Star Nursery Inc. will collect the following categories of personal information in order to provide products and services to you, to communicate with you, to enhance our products, services, and operations, and for other operational, business, legal, and compliance purposes:
- Identification information: that can be used to identify you and your account, such as your name, company name, address, phone number, email address, payment information, login and access credentials. We may also collect online identifiers, such as your IP address, when you browse our websites or use our applications.
- Commercial information: such as products or services you purchased or considered purchasing, including limited transaction histories stored at secure servers.
- Geolocation information and data: This includes, but not limited, to precise geolocation data. This is if you allow our application to collect it for purposes such as helping you locate the nearest Star Nursery location or for analytic purposes.
- Protected class information under state or federal laws, such as age, gender, and family status.
- Sensitive personal information: certain information described above is treated as “sensitive personal information” under the CCPA and similar state laws, including precise geolocation data and account log-in credentials in combination with a password or other credential permitting access to an account. We collect sensitive personal information only for the purposes described in this Privacy Statement, we do not sell or share it for cross-context behavioral advertising, and we do not use or disclose it for purposes other than those permitted by applicable law.
- Education information, related to Contact Us, potential for Surveys and direct Support Contact and Feedback.
Sourcing of Information:
You may choose to provide Star Nursery Inc. with information when you interact with us.
Examples of information that may be included:
- Identification information: You may provide your contact information in case we need to reach out to you. You may also set up your login and access credentials when creating or accessing your Star Nursery online account. To complete transactions, we collect your payment information. When you participate in contacting E-Store Support, Star Nursery generally does not retain personal information unless you provide your personal information in connection with a transaction (purchase under Star Nursery Online Account), in which case Star Nursery may record, use, and retain the data to fulfill your request efficiently and effectively.
- Commercial or Transaction information: You may provide or generate commercial or transaction information regarding your Star Nursery purchases, returns, and exchanges.
- Education information. You may provide education information through contact us and communication with Star Nursery E-Store Support.
Information that may be collected through automatic means:
We collect information by automated means online. When you use our website or mobile application, Star Nursery Inc. may collect certain information by using Cookies and Other Technologies. These technologies may be placed and operated by us or by advertising, analytics, and measurement vendors acting on their own behalf, and they may collect online identifiers and information about your browsing activity on our websites and application over time.
Categories of sources: We collect personal information directly from you; automatically from your browser and device when you use our websites and mobile application; from our service providers and contractors; from advertising, analytics, and measurement vendors; and from payment processors and fraud-prevention services.
Why We Collect Information:
We use your personal information for various business or commercial purposes, including but not limited to fulfilling products and services, communicating with you, supporting and enhancing our business functions and for other legal, compliance and security purposes.
We may use your identification information, commercial information, online activities, geolocation information, sensitive personal information, and other personal information to provide products and services to you, such as:
- Provide and deliver products and services, fulfill your orders and transactions.
- Process, record, and track your purchases.
- Process Payments.
- Identify and verify your identity when needed to provide you with products and services or access to our systems.
We may use all of the categories of information described under “What Information We Collect” section to facilitate and tailor our outreach to you, such as:
- Communicate with you through various channels with transactional or promotional information, such as transaction confirmation and reminder, promo codes, coupons, and other messages.
- Evaluate and respond to your requests and inquiries through E-Store Support.
- Potential to administer programs for product reviews by you and other customers.
We may use all of the categories of information described under “What Information We Collect” section to enhance our products, services and operations, such as:
- Conduct research and internal analytics, develop new products and services, perform market research and data analytics, and analyze our products, services, websites, and applications.
- Customize your experiences in our stores and online.
- Administering our websites and applications, and perform accounting, auditing, and billing.
We may use identification information, commercial information, online activities, geolocation, and audio, electronic, video, image and other personal information for legal, compliance, fraud prevention and security purposes, such as to:
- Comply with and enforce applicable legal requirements, industry standards and our policies.
- Assist law enforcement and respond to regulatory inquiries.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and take appropriate legal actions if necessary.
How Long We Keep Information:
We retain each category of personal information for as long as reasonably necessary to carry out the purposes described in this Privacy Statement, and thereafter for the period needed to comply with our legal, tax, accounting, warranty, and recordkeeping obligations, to resolve disputes, and to enforce our agreements. Account and identification information is retained for the life of your Star Nursery online account and for a reasonable period after it is closed; commercial and transaction information is retained for the period required by applicable tax and recordkeeping laws; online identifiers and browsing activity collected through cookies and similar technologies are retained for the periods disclosed in our cookie settings; and records of privacy rights requests are retained for the period required by applicable law. We do not retain personal information for longer than is reasonably necessary for the purpose for which it was collected.
Information Sharing:
Star Nursery Inc. uses reasonable administrative, technical, and physical safeguards to protect your personal information. We disclose personal information to service providers, contractors, and third parties as described below. Certain of these disclosures are made for advertising, analytics, and measurement purposes and constitute a “sale” and/or “sharing” of personal information for cross-context behavioral advertising under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CCPA”), and may constitute a sale of personal data or processing for targeted advertising under other state privacy laws. We do not sell or share the personal information of consumers we know to be under 16 years of age. The categories of disclosures we make are as follows:
Advertising, Analytics and Measurement; Cross-Context Behavioral Advertising:
Our websites and mobile application use cookies, pixels, tags, SDKs, and similar technologies that are placed or operated by advertising, analytics, and measurement vendors. Through these technologies we disclose to those vendors, and permit those vendors to collect directly, online identifiers and internet or other electronic network activity information—including IP address, device and browser identifiers, cookie identifiers and mobile advertising IDs, pages and products viewed, search terms entered, links and buttons clicked, session duration and timestamps, referring and exit URLs, and approximate location derived from IP address—together with commercial information about the products you view, add to your cart, or purchase.
These vendors use this information to measure and report on the performance of our websites and our advertising, to build and enrich audience segments, and to select and deliver advertisements to you on other websites, applications, and services, including advertising based on your activity across nonaffiliated websites and applications over time. Under the CCPA, these disclosures constitute the “sale” and “sharing” of personal information for purposes of cross-context behavioral advertising. Under other state privacy laws, they may constitute the sale of personal data or processing of personal data for targeted advertising.
You may opt out of these disclosures at any time. To do so, use the “Do Not Sell or Share My Personal Information.” link available on our website, or contact us using the information in the “Contact Us” section below. We also honor the Global Privacy Control (GPC) opt-out preference signal transmitted by your browser or device as valid requests to opt out for that browser or device. Because opt-out requests are recorded against the browser and device on which they are submitted, you may need to opt out separately on each browser and device you use, and again if you clear your cookies.
Cookies, Session Recording, Chat, and Your Consent to These Technologies:
Some of the technologies described above record your interactions with our websites and mobile application. These include session replay and analytics tools that log page views, mouse movements, clicks, scrolling, and information you enter into forms; chat and customer support tools that create and store a transcript of your conversation; and pixels, tags, and SDKs that report your activity to the vendors that operate them. Vendors that provide these tools do so on our behalf under written contracts that limit their use of the information to the services they perform for us, except for the advertising, analytics, and measurement vendors identified above, which may also use the information for their own cross-context behavioral advertising purposes.
By using our websites, mobile application, or chat features, you consent to the recording, collection, storage, and disclosure of these communications and interactions by Star Nursery and its vendors as described in this Privacy Statement. If you do not consent, you should not use our websites, mobile application, or chat features, and you may instead contact us by telephone or visit a Star Nursery location. You may also disable cookies and similar technologies through your browser settings or the cookie preference controls on our website, and you may exercise the opt-out rights described below.
Legal, Law Enforcement, Security and Investigation:
We may disclose information about you if:
- We are required to do so by law, regulation or legal process, such as a court order or subpoena.
- We deem appropriate or necessary in response to requests by government agencies, such as law enforcement authorities or tax authorities.
- We believe disclosure is appropriate or necessary to protect the rights, property or safety of Star Nursery locations, our customers, or others, including to prevent physical, financial or other harm, injury or loss.
- If an account is suspected of fraud or in connection with an investigation of suspected or actual unlawful activity.
Personal Information Disclosed for Business Purposes:
We disclose all the categories of personal information described under “What Information We Collect” section to service providers and contractors for business purposes, including fulfilling products, services and transactions, facilitating customer communication, enhancing our products, services and operations, and complying with legal, compliance, law enforcement and security requirements.
Children’s Privacy:
Our websites and mobile application are intended for a general audience and are not directed to children. We do not knowingly collect personal information from children under 13 years of age, and if we learn that we have collected such information we will delete it. We do not sell or share the personal information of consumers we know to be under 16 years of age. We do not process the personal data of a consumer we know to be at least 13 and under 16 years of age for targeted advertising or sale without that consumer’s consent, or of a consumer we know to be under 13 without the consent of a parent or guardian.
Your Rights to your Privacy:
Residents of certain states have rights to access, delete, correct, or opt-out from certain types of processing or sharing of their personal information. Depending on your state of residency and subject to certain legal limitations and exceptions, you may be able to exercise some or all the following rights:
- Accessing your personal information: You may request confirmation of the processing of your data and to access a copy of your personal information we maintain about you.
- Correcting your information: You may request to correct inaccurate personal information we maintain about you. If you would like to change information related to your order or services, please contact a store manager or E-Store Support.
- Obtaining a portable copy of your information: You may request a copy of the personal information you provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the information to another entity without hindrance.
- Deleting your information: You may request that Star Nursery delete your personal information we maintain about you subject to certain exceptions permitted by law such as to complete the transactions, detect security incidents, prevent fraudulent or illegal activities, identify and repair errors, comply with laws and regulations, and for other solely internal and lawful purposes. Once an account is deleted there is no recovery option for the account or information related to it.
- Opting out of the sale or sharing of your personal information: You may direct Star Nursery not to sell or share your personal information, including for cross-context behavioral advertising or targeted advertising. To exercise this right, use the “Do Not Sell or Share My Personal Information.” link available on our website or contact us as described in the “Contact Us” section below. We also honor opt-out preference signals, including the Global Privacy Control (GPC), transmitted by your browser or device.
- Authorized agents: You may designate an authorized agent to submit a privacy rights request on your behalf. We may require the agent to provide proof of your written authorization and may require you to verify your own identity with us directly before acting on the request.
- Sensitive information. To the extent that Star Nursery collects and processes “sensitive personal information,” we obtain opt-in consent as required by applicable law. Residents of certain states may make as request for Star Nursery to limit the use and disclosure of sensitive personal information for certain purposes permissible by law, such as providing products or services, detecting security incidents and protecting safety, preventing fraud or illegal actions, and maintaining the quality of services we provide. Please note that the definition of sensitive personal information varies by state, so your rights with respect to specific types of information will depend on your state of residency.
- Non-discrimination for exercise of privacy rights: We will not discriminate or retaliate against you for exercising your rights under relevant state privacy laws.
- Appeal your request. Residents of certain states may appeal a decision to not take action on your privacy right request within a reasonable time after your receipt of the decision.
- How to Submit a Request: You may submit a privacy rights request by contacting us using the information in the “Contact Us” section below or by emailing us at privacy@starnursery.com. To opt out of the sale or sharing of your personal information, you may also use the “Do Not Sell or Share My Personal Information.” link on our website or transmit an opt-out preference signal such as the Global Privacy Control from your browser or device.
- Verification and response: Before acting on a request to know, delete, or correct, we will take reasonable steps to verify your identity using information we already maintain about you, and we may request additional information for that purpose. We will acknowledge receipt of your request within 10 business days and respond within 45 calendar days, which we may extend by an additional 45 calendar days where reasonably necessary, in which case we will notify you of the extension and the reason for it. We do not charge a fee to respond to a request unless it is excessive, repetitive, or manifestly unfounded. Requests to opt out of the sale or sharing of personal information do not require verification and are processed within 15 business days.
State-Specific Disclosures:
A number of states have enacted comprehensive consumer privacy laws, and certain other states regulate specific practices such as the sale of covered information. If you are a resident of a state with a privacy law that applies to Star Nursery, the rights described in the “Your Rights to your Privacy” section are available to you to the extent that law provides them, and you may exercise them using the methods described in “How to Submit a Request.” Rights, exceptions, and applicability thresholds vary by state, and not every state privacy law applies to every business. Where a right is not provided by your state’s law, or where that law does not apply to Star Nursery, the right is not available to you. The disclosures below address states whose laws call for specific notices.
- Nevada Residents: Nevada law permits residents to submit a verified request directing a website operator not to make any sale of covered information it has collected about them. Nevada residents may submit such a request using the contact information in the “Contact Us” section below, and must include their name, contact information, and a statement that they are a Nevada resident.
- California Residents: Right to know and access the personal information we collect, use, disclose, sell, and share; right to delete; right to correct inaccurate personal information; right to opt out of the sale and sharing of personal information, including for cross-context behavioral advertising; right to limit the use and disclosure of sensitive personal information; right to non-discrimination for exercising these rights; and the right to designate an authorized agent. California residents may also request the specific pieces of personal information we hold about them, the categories of personal information we disclosed for a business purpose, and the categories of third parties to whom we sold or shared personal information in the preceding 12 months.
